License Agreement

NOTICE — PLEASE READ THIS LICENSE AGREEMENT AS WELL AS THE RUSTPROOF LABS TERMS OF SERVICE AND PRIVACY POLICY (COLLECTIVELY, THE “AGREEMENT”) BEFORE PURCHASING, ACCESSING, DOWNLOADING, PRINTING OR USING THE EBOOK. IF YOU DO NOT ACCEPT THIS AGREEMENT, DO NOT ACCESS THE EBOOK AND DELETE OR DESTROY ANY COPIES AND/OR EXCERPTS OF THE EBOOK. IN THE EVENT OF A CONFLICT BETWEEN THIS LICENSE AGREEMENT AND THE TERMS OF SERVICE OR PRIVACY POLICY, THE TERMS OF THIS LICENSE AGREEMENT SHALL PREVAIL. RUSTPROOF LABS LLC PROVIDES THE EBOOK ON THE CONDITION THAT YOU ACCEPT AND COMPLY WITH THE AGREEMENT. BY CLICKING THE "ACCEPT" BOX AT THE TIME OF PURCHASE AND/OR BY ACCESSING AND USING THE EBOOK, YOU (A) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS; AND (B) REPRESENT AND WARRANT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT.

LICENSE. The EBook is licensed, not sold, to you by RustProof Labs, LLC. (“RustProof Labs”). The EBook will also include any updates of the EBook made available to you by RustProof Labs. Subject to the terms of the Agreement, RustProof Labs grants you a worldwide non-exclusive, non-transferable, revocable, limited license to access and use the EBook via a browser and/or to download the EBook to a single device for your personal, non-commercial purposes only. You may use this EBook on any computer, but may not store it such that it can be downloaded or accessed from any public network, including the internet. You may print the EBook, in whole or in part, for your own personal use only. You agree to use your best efforts to prevent and protect the contents of the EBook from unauthorized access, disclosure or use in contravention of this Agreement.
LIMITATION ON USE. You may not rent, lease, sell, assign, loan or otherwise transfer, sublicense. or distribute copies, including but not limited to electronic or printed copies, in whole or in part, of the EBook to others or remove any proprietary notices, labels, or marks from the EBook. You may not modify, adapt, or translate the EBook without the prior written consent of RustProof Labs. You may not install all or any portions of the EBook on any computer system on a public or private network or archival database or other searchable database where the contents of the EBook might be accessible to individuals who are not licensed users of the EBook. Sharing of license codes or passwords required to access the EBook is STRICTLY PROHIBITED.
COPYRIGHT. Except for the license granted in this Agreement, all right, title and interest in the EBook, in all languages, formats and media throughout the world, including all copyrights, are and will continue to be the exclusive property of the author, Ryan Lambert and his licensors and contributors. You may not copy, download, print, scrape, store, publish, transmit, retransmit, transfer, distribute, disseminate, broadcast, circulate, sell, resell or otherwise use the EBook, or any portion of the EBook, in any form or by any means, except (i) as expressly permitted by this Agreement, (ii) with RustProof Labs’ or the author’s prior written permission, or (iii) as permitted under the fair use provision of the Copyright Act (17 U.S.C.A. § 107).
OPENSTREETMAP. The EBook contains a data extract from OpenStreetMap, which is made available under the Open Database License (ODbL). See the OpenStreetMap copyright and ODbL license pages for more information.
TERM AND TERMINATION. The license granted under Section 1 hereof will remain in effect until terminated and will automatically terminate if you fail to comply with this Agreement. You agree that, upon such termination, you will either destroy or permanently delete all copies of the EBook.
DISCLAIMER OF WARRANTIES. THE EBOOK IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OMISSIONS, COMPLETENESS, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE, OR TRADE PRACTICE. RUSTPROOF LABS DOES NOT WARRANT THAT THE OPERATION OF THE EBOOK WILL BE UNINTERRUPTED OR ERROR FREE.
LIMITATION OF LIABILITY. IN NO EVENT WILL RUSTPROOF LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE EBOOK, REGARDLESS OF WHETHER SUCH DAMAGE WAS FORESEEABLE OR RUSTPROOF HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RUSTPROOF LABS’ AND THE AUTHOR’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU FOR THE EBOOK.
PAYMENT. The license fee is payable in advance in the manner set forth in the order form and is non-refundable.
GOVERNING LAW, JURISDICTION. This Agreement will be governed by, and construed in accordance with, the laws of the State of Colorado without regard to conflicts of law principles with exclusive jurisdiction and venue in the appropriate courts located in the City and County of Denver, Colorado for all claims arising out of or related to this Agreement.
EXPORT RULES. The EBook and its contents may be subject to US export control laws, including the Export Control Reform Act and its associated regulations. You shall not, directly or indirectly, export, re-export, or release the EBook or its contents, or make the EBook or its contents accessible from, any jurisdiction or country to which export, re-export, or release is prohibited by law, rule, or regulation.
ENTIRE AGREEMENT. This Agreement constitutes the sole and entire agreement between the parties with respect to the EBook, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
SEVERABILITY. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
